DMCA Notice and Takedown Policy

1. Notification of Infringement

If you are a copyright owner or an agent authorized to act on behalf of a copyright owner, and you believe that any content posted on Quoriz has infringed upon your copyright, you may submit a notice of infringement pursuant to the Digital Millennium Copyright Act (“DMCA”). A DMCA notice must be submitted to Quoriz’s designated Copyright Agent, and it must include specific information to facilitate the removal or disabling of access to the infringing material. If you submit a notice, please ensure that it contains the following information:

  1. Identification of the copyrighted work that is allegedly being infringed. This should clearly identify the work by title, URL, or other identifying characteristics. If multiple copyrighted works are the subject of a single notification, a representative list of such works may be provided.
  2. Identification of the material that is claimed to be infringing, or the subject of infringing activity. This includes the exact location of the alleged infringing material on the website. For example, the URL(s) of the material you claim to be infringing.
  3. Contact information of the complaining party. This should include the name, physical address, telephone number, and email address of the complaining party.
  4. A statement of good faith belief that the material has been removed or disabled in error or as a result of a mistake, and that the complaining party believes in good faith that the material was not authorized by the copyright owner, its agent, or the law.
  5. A statement under penalty of perjury that the information contained in the notice is accurate and that the complainant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature or the signature of a person authorized to act on behalf of the copyright owner.

Upon receiving a DMCA notice, Quoriz will promptly review the submission and, if appropriate, remove or disable access to the content that is believed to be infringing. Quoriz will also notify the user who posted the allegedly infringing material of the notice, allowing them the opportunity to submit a counter-notice as described below.

2. Counter-Notice

If you are a user of Quoriz and believe that your content was removed or disabled in error, or because it was mistakenly identified as infringing, you may submit a counter-notice. A valid counter-notice must contain the following information:

  1. Identification of the material that has been removed or to which access has been disabled. You must provide the specific location of the content before it was removed or disabled, such as the URL(s) of the material.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  3. Your name, address, telephone number, and email address. If you are not located within the United States, your address and phone number should be located within the jurisdiction where Quoriz is located.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located or, if your address is outside the United States, for any district in which Quoriz may be found, and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
  5. Your physical or electronic signature. This may be a scanned signature or typed name.

The counter-notice should be sent to the following:

Upon receiving a valid counter-notice, Quoriz will forward the counter-notice to the original complainant. If no action is taken by the complainant, and no legal action is filed within 10 business days, Quoriz may restore the removed content.

3. Repeat Infringer Policy

Quoriz implements a policy of terminating user accounts that are found to be repeat infringers. A “repeat infringer” is defined as any user who has been the subject of multiple DMCA takedown notices. Upon receiving notices from copyright holders, we will remove infringing content and issue warnings to users. However, if a user accumulates multiple infringements or is deemed a repeat infringer, Quoriz reserves the right to permanently suspend or terminate that user’s account.

In cases where a user has been terminated or suspended for infringing activities, Quoriz will retain the right to refuse that user access to the platform in the future. Additionally, we may track these incidents and maintain a log of repeat offenders.

4. No Liability for Content

Quoriz does not pre-screen, review, or approve content that users post. The content on Quoriz is posted by users and is not monitored or controlled by Quoriz. Quoriz operates under the safe harbor provisions of the DMCA, which shield online service providers from liability for infringing content uploaded by users. We are not liable for infringing content posted by users unless we are notified of such infringement and fail to act upon such notification.

5. Indemnification

By posting content on Quoriz, you agree to indemnify and hold harmless Quoriz, its affiliates, directors, officers, employees, agents, and contractors from any claims, damages, costs, or expenses (including reasonable attorneys’ fees) arising from a third-party claim related to your content or the alleged infringement of a third party’s copyright. This includes any legal action or liability arising from your failure to comply with the DMCA.

6. Rights of Quoriz

Quoriz reserves the following rights with respect to DMCA notices:

  1. To remove or disable access to content upon receiving a valid DMCA takedown notice that complies with the requirements of the DMCA.
  2. To take down content without prior notice to the user, especially if it is clear that the content is infringing the rights of the copyright owner or if there are multiple notices about the same content.
  3. To refuse to restore content to the platform if we believe the content violates copyright law, our policies, or any other legal framework.
  4. To terminate the accounts of repeat infringers in accordance with our Repeat Infringer Policy.
  5. To modify this DMCA policy and our procedures for DMCA notifications and takedowns at any time, and such modifications will be effective immediately upon posting.
  6. To comply with court orders, subpoenas, or other legal requirements. If required, we will release personal user data or account information as per court orders, regulatory requirements, or subpoenas.

8. Governing Law

This DMCA Policy is governed by the laws of Cyprus. If any disputes arise concerning the enforcement of this policy, or any takedown or counter-notice, those disputes shall be adjudicated in the appropriate courts located in Cyprus.

9. Modifications and Updates

Quoriz reserves the right to modify or update this DMCA policy from time to time. When changes are made, the “Effective Date” of the policy will be updated, and the new policy will take effect immediately upon posting. It is your responsibility to review this policy periodically to ensure you are aware of any modifications.

10. Termination of Access

In addition to the above policies, Quoriz may also terminate or suspend access to our platform if any user engages in activities that violate the DMCA or our Terms of Use. If a user is found to be posting infringing content repeatedly, Quoriz reserves the right to permanently suspend or delete their account and all associated content.

11. DMCA Takedown Process and Timeline

Once Quoriz receives a valid DMCA takedown notice, we will take action in accordance with the DMCA’s safe harbor provisions, typically within 24-72 hours. The removal or disabling of access to the infringing content will be based on the details provided in the notice. If a counter-notice is filed, the original complainant will be notified, and Quoriz will proceed to restore the content after 10 business days if no further legal action is initiated by the complainant.
